El presente ensayo tiene un enfoue de investigacin cualitativo y un alcance descriptivo por ello la metodologa utilizada para su construccin corresponde a la revisin documental o bibliogrca ue permite analizar el papel de los ueces en el control difuso de constitucionalidad. Para esto se tendr en cuenta el marco del neoconstitucionalismo colombiano. El principal hallazgo obtenido es ue el papel de los ueces en un ordenamiento urdico no debe sobreentenderse como el cumplimiento de funciones mecnicas y prestablecidas, sino que debe obedecer al contexto social en el que se desempeñe e ir de la mano con el desarrollo de los pueblos y la evolucin del derecho ue rige en ellos. As pues el neoconstitucionalismo como teoría del derecho, plantea el estudio de las nuevas formas, conceptos y procedimientos que surgen a partir de las constituciones modernas y ue imponen retos a todas las instituciones entre ellas las udiciales. El sistema de control difuso de constitucionalidad es una de las guras ue eige ser analizada estructurada y asumida como un reto a la luz del neoconstitucionalismo en la eperiencia y el conteto propio colombiano.
The present essay has a ualitative research approach and a descriptive scope therefore the methodology used for its construction corresponds to the documentary or bibliographical revision that allows analyzing the role of the udges in the diffuse control of constitutionality. This will take into account the framework of Colombian neoconstitutionalism. The main nding obtained is that the role of udges in a legal system should not be understood as the fulllment of mechanical and preset functions but must obey the social contet in which they perform and go hand in hand with the development of peoples and the evolution of the law that governs them. Thus neoconstitutionalism as a theory of law proposes the study of new forms concepts and procedures that arise from modern constitutions and impose challenges on all institutions including udicial institutions. The diffuse control system of constitutionality is one of the gures that demands to be analyzed structured and assumed as a challenge in the light of neoconstitutionalism in the Colombian experience and context.
