El objetivo de esta investigación consiste, en la posición que ha asumido la Corte Constitucional en la revisión de las sentencias instituidas por las acciones constitucionales, cuando la causa litigiosa ha sido el derecho al agua. La metodología empleada fue la de la investigación jurídica pura y básica del derecho, las técnicas de recolección de la información son la ficha bibliográfica y las matrices de análisis, que permiten realizar un análisis de contenido a las sentencias que han emanado de la Corte Constitucional con una postura jurídica sobre el agua como derecho fundamental o humano de los colombianos. Hallamos que la Corte Constitucional ha establecido varias posiciones sobre la relación que el agua tiene con la vida de los seres de la naturaleza, pero sobre todo en el ser humano, considerando que la falta del servicio de acueducto, por ejemplo, atenta directamente contra el derecho fundamental a la vida.
The objective of this investigation is to investigate the position assumed by the Constitutional Court in the review of the sentences instituted by constitutional actions when the litigious cause has been the right to water. The methodology used was that of the pure and basic legal research of the law, the information gathering techniques are the bibliographic record and the analysis matrices, which allow a content analysis to be carried out on the sentences that have emanated from the Constitutional Court with a legal position on water as a fundamental or human right of Colombians. We find that the Constitutional Court has established several positions on the relationship that water has with the life of natural beings, but above all in humans, considering that the lack of aqueduct service, for example, directly threatens the fundamental right to life.
