El presente trabajo tiene como referente los antecedentes históricos y jurídicos del diferendo entre Colombia y Nicaragua por el archipiélago de San Andrés, Providencia y Santa Catalina, del que ha tenido conocimiento la Corte Internacional de Justicia en recientes fallos expedidos desde 2017 hasta el presente. La finalidad del trabajo es la de resaltar la estrecha vinculación que nuestro país tuvo siempre con Centroamérica y particularmente con la región de la Mosquitia, por cuyo dominio sean registrado pretensiones no solo de Nicaragua y Colombia sino incluso de Costa Rica y hasta de la misma Honduras, y realzar la necesidad que tiene el archipiélago de que para su desarrollo que requiere se le constituya, mediante una reforma constitucional en hecho Insular.
This paper is based on the historical and legal background of the dispute between Colombia and Nicaragua over the archipelago of San Andrés, Providencia and Santa Catalina, which has been brought to the attention of the International Court of Justice in recent rulings issued from 2017 to the present. The purpose of this paper is to highlight the close ties that our country has always had with Central America and particularly with the Mosquitia region, for whose domain claims have been registered not only by Nicaragua and Colombia but even by Costa Rica and even Honduras itself, and to highlight the need for the archipelago to be constituted, through a constitutional reform, as an Insular fact.
